According to El Salvador's Planting Seed Law, enacted in September 2001, it is prohibited to import, conduct research, produce or commercialize GMO seeds. El Salvador's Environment Law, enacted in May 1998, provides regulations for carrying out studies on the environmental impact of GMOs and also provides guidance for procedures on bio-safety norms. The Planting Seed Law is enforced by the Animal/Plant Inspection Division of the Ministry of Agriculture (503) 228-4443.

El Salvador has also ratified the Cartagena Protocol which allows signatories to deny entry to GMOs/biotech products. The Protocol will become effective in December 2003, at which point Annex 1, 2, and 3 will be applied.

As of November 1, 2003, no procedure for inspection or testing of these products is currently in place. No traceability system is in place. All seeds must have a phyto-sanitary certificate with an additional declaration that the seeds do not contain GMOs. No special labeling for GMO/biotech products is required at this time. Under the Cartagena Protocol, effective in December, a risk analysis will be required for each GMO/biotech product.

The El Salvadoran government is currently conducting a project funded by the United Nations to define the legal framework for a law that would provide guidance for proposals to regulate agricultural GMO/biotech products and also would define coordination among the Ministries of Health, Agriculture and Environment on these issues.
